Truck Wreck Wrongful Death | $8,000,000 Settlement

Overview:
We represented the children of a woman who tragically lost her life when her vehicle collided with a tractor-trailer while driving home from work.

The initial investigation concluded that our client’s mother caused the crash that led to her vehicle hitting the tractor-trailer, and the responding officer did not place any fault or issue a citation to the truck driver. Additionally, the trucking company defended the case by blaming the decedent for the crash.
Our Work:
Through aggressive litigation, we uncovered critical evidence showing that the tractor-trailer was improperly stopped on the highway, violating multiple Federal Motor Carrier Safety Regulations (FMCSR), including Roadside Parking (392.2), Unsafe Vehicles (396.7), and Driving While Ill or Fatigued (392.3). Our team secured key admissions through written discovery and the deposition of the truck driver, ultimately proving that the trucking company, at a minimum, shared responsibility for the tragedy.
Result:
We obtained an $8,000,000 settlement for the woman’s children, providing them with financial security and a measure of justice for the loss of their mother.
