Slip and Fall Leg Fracture and Surgery | $1,912,500 Settlement


Overview:
Our client, an independent senior resident at an assisted living facility, slipped and fell on ice that had accumulated in a common area, suffering a serious leg fracture that required emergency surgery.
Injuries:
Broken leg requiring emergency surgery, two weeks of hospitalization, and two additional weeks in a rehabilitation facility. Her health and ability to live independently significantly declined after the fall.
Challenges:
Initial investigations suggested the ice came from a broken pipe. However, through discovery, we uncovered evidence showing the ice was caused by an improperly operating sprinkler system, which was running despite freezing temperatures.
Our Work:
We filed suit against the facility and, after further investigation, added the landscaping contractors responsible for the sprinkler system as defendants. We established each defendant’s individual negligence and breaches of their contracts with one another. Although the defendants initially denied liability, after aggressive litigation involving over a dozen depositions and the case being placed on a trial calendar, we negotiated a combined settlement.
Result:
We secured a $1,912,500 settlement for our client and avoided a lengthy trial.
